GENERAL TERMS AND CONDITIONS OF COMPETITIONS ORGANIZED BY FORM FACTORY S.R.O.
1. Competition Organizer
The organizer of the competitions is Form Factory s.r.o., Praha 3, Vinohradská 2405/190, ZIP code 130 00, Company ID: 05785880, registered in the Commercial Register maintained by the Municipal Court in Prague under file number C 270769 (hereinafter referred to as the “Organizer”).
2. Participation in the Competition
2.1. Only natural persons over the age of 18 with a delivery address in the Czech Republic may participate in the competition, unless stated otherwise in the specific competition rules.
2.2. By participating in the competition, the participant confirms that they meet the conditions for participation and agree to these general rules.
2.3. Employees of the Organizer, their family members, and persons cooperating in the implementation of the competition are excluded from participation.
3. Competition Procedure and Rules
3.1. The rules, method of participation, competition duration, and prize specifications are always stated in the specific competition announcement (e.g., in the post description, on the website, or on an informational leaflet in the club).
3.2. The Organizer reserves the right to modify, suspend, or cancel the competition at any time without compensation.
3.3. The Organizer reserves the right to disqualify a participant in the event of suspected fraudulent behavior or violation of the rules.
4. Prizes and Prize Distribution
4.1. Winners are determined according to the rules stated for the specific competition (e.g., by drawing lots, evaluating the completion of a task, etc.). The drawing is conducted electronically by a responsible employee of the company.
4.2. Winners will be contacted through the platform on which the competition was held (e.g., Instagram, Facebook, email).
4.3. If the winner does not respond to the prize notification within 5 business days, the prize will be forfeited.
4.4. The prize must be collected at a designated location within 30 days of the announcement and delivery of the prize notification.
4.5. There is no legal entitlement to the prize. Prizes are not exchangeable for cash or any other compensation and are not enforceable by legal action.
5. Personal Data Protection
5.1. By participating in the competition, the participant gives the Organizer consent to process personal data for the purpose of organizing the competition, contacting the winner, and marketing communication.
5.2. Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR).
6. Liability
6.1. The Organizer is not responsible for technical errors that may affect participation or the course of the competition.
6.2. The Organizer is not responsible for the loss, damage, or delayed delivery of prizes caused by third parties.
7. Specific Terms for Competitions on Meta Platforms (Facebook and Instagram)
7.1. Competitions are in no way sponsored, administered, or associated with Meta Platforms, Inc., Facebook, or Instagram.
7.2. The participant acknowledges that they are providing their information to the Organizer, not to Meta.
7.3. Meta is not responsible for the course of the competition or any related claims.
7.4. The participant agrees not to use fake accounts, tag non-existent profiles, or otherwise manipulate the results.
7.5. If the participant submits content (e.g., a comment, photo, video), they confirm that:
- they are the author or have the rights to use the content,
- the content does not violate any laws or Meta’s rules,
- they grant the Organizer consent to further use the content for marketing purposes (e.g., reposting the winning entry).
7.6. Winners will only be contacted through official Form Factory accounts. The Organizer never requests information via suspicious links or third parties.
7.7. The Organizer reserves the right to delete comments that are offensive or otherwise inappropriate (i.e., unrelated to the topic of the competition), unsolicited advertisements, and to block their authors if necessary.
8. Final Provisions
8.1. The Organizer reserves the right to modify these conditions at any time.
8.2. By participating in the competition, the participant confirms that they have read and agree to these terms.
